GG Platform Terms and Conditions

These Terms and Conditions are effective as of 12 March 2022

DEFINITIONS:

GG – ( Gadu-Gadu) – Instant messenger owned by Fintecom Sp. z o. o., with its registered office in Koszalin;

Fintecom – Fintecom Sp. z o.o. incorporated under the laws of Poland. Registered address: ul. Marszalka Jozefa Pilsudskiego 45, 75-502 Koszalin, Poland. KRS 0000362067; REGON 320877907; NIP 6692501424; having the status of a National Payment Institution [Krajowa Instytucja Płatnicza], supervised by the Polish Financial Supervision Authority (licence no. IP4/2013). The share capital of the company amounts to PLN 600,000, paid in full;

KNF – Polish Financial Supervision Authority, ul. Piekna 20, 00-549 Warsaw; www.knf.gov.pl;

Service – a service provided electronically as part of the GG online communication platform;

GG Standard – a basic, free service provided in the GG Instant Messenger;

GG Premium – a paid service, in the form of a benefits package, provided by Fintecom in the GG Instant Messenger;

Service Functionalities – particular services used by the User within the GG Instant Messenger;

Terms and Conditions – these terms and conditions of the service provided in the GG Instant Messenger;

GG User – a natural person or a legal entity registered in the GG Instant Messenger and assigned a unique GG number;

Account Registration – the act of providing by the User the data, including personal data, necessary to create a GG account;

Account Verification – confirmation of the User’s identity accomplished by Fintecom by the way of comparison of the data provided by the User during Registration with the User’s data included in the bank confirmation of the Verifying Transfer;

GG Moneybox – a paid service provided by Fintecom in the GG Instant Messenger enabling making voluntary payments to verified Users of the GG Instant Messenger;

Personal Data – data provided by the User and collected on the Website, including data collected as part of registration, as well as any other information about an identified or identifiable natural person collected from the User and processed by Fintecom for the proper provision of the Service;

Privacy Policy – the document describing the rules of collecting, processing and protection of personal data, applicable on the GG website, within the scope of the services provided, available at “GG Privacy Policy”

Act – the Act of 18 July 2002 on Providing Services by Electronic Means

Section I. GENERAL PROVISIONS

  1. The following provisions constitute the Terms and Conditions (hereinafter the “Terms and Conditions”) referred to in the Article 8 of the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws 2002 no. 144, item 1204, as amended) (hereinafter the “Act”).
  2. These Terms and Conditions define the rules of providing services electronically by Fintecom Sp. z o.o. with its registered office in Koszalin, and the address at: ul. Marszalka Pilsudskiego 45, 75-502 Koszalin, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the city of Koszalin, IX Commercial Division, under number 0000362067 (hereinafter “Fintecom), as part of the online communication platform provided by Fintecom’s ICT system (hereinafter the Platform”).
  3. Fintecom has the status of a National Payment Institution, is supervised by the Polish Financial Supervision Authority and is allowed to provide Payment Services within the scope of the granted licence (licence no. IP4/2013).
  4. Fintecom’s ICT system includes a set of cooperating IT devices and software ensuring processing and storage of data, as well as sending and receiving data via telecommunication networks, by means of a terminal device appropriate for the specific type of network.
  5. The provision of services by Fintecom by electronic means consists of making available to the Users certain functionalities of the Platform (in the case of some functionalities, together with the necessary software) with specific characteristics (hereinafter “Functionalities”) and is accomplished by sending and receiving data via ICT systems, at the individual request of the User, without the simultaneous presence of the parties, with the data being transmitted via public networks (hereinafter the “Service”).
  6. The Service is provided to:
    1. natural persons with full or limited legal capacity who are at least 16 years old,
    2. other entities having legal capacity on the basis of separate regulations who have accepted the Terms and Conditions and entered into an agreement for the provision of the Service (hereinafter a “GG User”).
  7. Fintecom provides access to the information referred to in the Section 6 of the Act at “Threats”.
  8. The Basic Service is provided free of charge, however, some additional Functionalities of the Instant Messenger may be limited and available in full for a fee in the GG PREMIUM version.
  9. The Service is provided free of charge as a result of the User’s commencement of use of the available Platform Functionalities.
  10. Paid Functionalities are made available at the individual request of the User after the User accepts the terms and conditions of the paid provision of the Service.
  11. By creating an account in the GG Instant Messenger, the User agrees to the provisions of these Terms and Conditions.
  12. By accepting the Terms and Conditions of GG, the User agrees to the publication of their content, photos/graphics, including consent to the publication of their image, if the published photos/graphics contain it.

Section II. TYPES AND SCOPE OF THE SERVICE COVERED BY THE TERMS AND CONDITIONS

  1. Fintecom provides the Service with different Functionalities within the Platform.
  2. The Functionalities include, in particular:
    1. sending text messages,
    2. sending graphic messages,
    3. sending text and graphic messages,
    4. audio/video calls,
    5. transmission of compressed multimedia messages,
    6. archiving of transmitted messages,
    7. provision of space in Fintecom’s ICT system resources (hosting) for storing data (files) and its synchronization between the ICT system and terminal devices,
    8. sharing entered data (files) with other Users,
    9. providing the ability to use applications that extend the Functionalities, whether provided by Fintecom or by third parties,
    10. pairing with random users,
    11. receiving codes and notifications from external entities.
  3. Fintecom provides information, instructions and explanations regarding the Service or the Functionalities on the Platform, in a separated form (including graphic fields, pop-up windows and others) or by referring to the operating manual, when the User performs certain activities using the tools or software provided by Fintecom as part of the Service.
  4. Fintecom enables the User to verify their GG account by means of a verifying transfer made from the User’s bank account to the Fintecom bank account. One User can verify one GG account.
  5. Fintecom updates the data referred to in paragraph 2 and 3 in the event of changes to the scope of the Service or the Functionality provided.
  6. Fintecom informs about changes to the parameters of the Functionalities at  “Technical Parameters of the Service“.
  7. The Platform also enables access to applications provided by third parties. In such cases, the application is not considered a part of the Platform and the use of it by the User does not constitute the use of the Service, of which the User is informed before using the application, and the transmission of data from Fintecom’s ICT system required to use such application takes place on the User’s request and risk. Completion by the User of the installation process of an application made available through the Platform by a third party is tantamount to the User’s request to Fintecom for transferring of certain data, including personal data with the User’s consent, from the Fintecom ICT system. By uninstalling a particular third-party application, the User is revoking their consent to the transfer of data.

Section III. TERMS OF SERVICE

  1. Provision of the Service requires the User to have an ICT system that meets the following minimum technical requirements:
    1. internet access,
    2. terminal device,
    3. in some cases, the use of software capable of reading files in various formats (including graphics, audio, multimedia, text, video, etc.).
  2. The rules for entering and storing data in Fintecom’s ICT system and the technical requirements are provided by Fintecom at the following addresses:
  1. If Fintecom provides software for the use of a certain Functionality, the User has the right to use the Service within this scope only using Fintecom’s software or third party software provided with consent and by Fintecom. Accessing the Service or its Functionalities with the use of software from entities other than Fintecom or with a third party software provided without the consent of Fintecom constitutes a violation of the Terms and Conditions. Fintecom shares information about the software used to access Functionalities provided by Fintecom at: List of Authorised Software
  2. Fintecom provides other Users in the Fintecom ICT system with the data selected and entered by the User in order to provide the Service to other Users.
  3. The Users may discontinue use of the Service at any time.
  4. The Users are obliged to:
    1. comply with the law, the Terms and Conditions, observe decency and generally applicable principles of Internet usage,
    2. use the Service in a manner that does not violate the rights of Fintecom or any third party,
    3. refrain from mass registration of GG Accounts for purposes incompatible with the intended use of the Service.
  5. In order to limit mass registration of GG Accounts, Fintecom limits the number of accounts created using the same telephone number.
  6. If the User wants to create more GG accounts using a single phone number, they should contact the GG Customer Service using the contact information provided on the GG website. In justified cases, it is possible to create more GG accounts using one phone number and this applies mainly to business GG accounts. Fintecom reserves the right to make individual decisions in this matter.
  7. The User shall refrain from engaging in any unlawful activity while using the Service, in particular:
    1. use of the Service, direct or indirect, for any purpose that violates the law, these Terms and Conditions, decency, or generally accepted principles of Internet usage,
    2. use of the Service in any manner that violates the rights of Fintecom or any third party,
    3. use of the Service with software other than Fintecom’s software or third party software provided with the consent of Fintecom,
    4. providing by or to Fintecom’s ICT system any data that:
      1. causes dysfunction or overload of Fintecom’s ICT system or of any third parties directly or indirectly involved in the provision of the Service,
      2. constitutes unsolicited commercial information addressed to a designated recipient within the meaning of the Act (spam),
      3. violates the law, the Terms and Conditions, interest of Fintecom or third parties, decency, generally accepted principles of Internet usage.
  8. Fintecom uses technical systems to prevent misuse of the Services.
  9. Fintecom may permanently or temporarily discontinue provision of the Service or the Functionalities to the Users in the event of:
    1. a violation or a reasonable suspicion of a material breach (temporarily until clarification) or a material breach by the User of the law, the Terms and Conditions, the rights of Fintecom or third parties, decency, generally accepted principles of Internet usage.
    2. the User’s failure to agree to amend the Terms and Conditions within the period specified in Section X, par. 2(a) of the Terms and Conditions.
  10. Permanent or temporary cessation of the Service may occur, among other things, as a result of the following breaches by the User:
    1. sharing or transmitting content that is pornographic, racist, offensive against religious feelings, inciting hatred and violence, obscene, offensive or otherwise violates the law or decency,
    2. depicting nudity if the person depicted is fully nude or only slightly covered in a manner that would be unacceptable in a public place,
    3. posting photos, pictures, drawings of an erotic nature, describing fetishes,
    4. posting photos, pictures, drawings or symbols of totalitarian regimes,
    5. posting or transmitting material that promotes hatred or depicts violence, self-harm, etc.
    6. creating accounts with the purpose of exchanging or selling erotic photos or videos,
    7. creating romance scammer accounts,
    8. representing gender and sexual preference in the “Name” and “Location” fields,
    9. use of threats, harassment, stalking or other actions that violate the rights of third parties (violations reported by other Users),
    10. using software to automatically pair with random users,
    11. unlawful use of an image, identity theft or impersonation,
    12. phishing for GG account credentials,
    13. fraud, information theft, software piracy or copyright infringement,
    14. phishing, unauthorized data interception, data integrity breach,
    15. fraud or solicitation of money transfers,
    16. soliciting financial investments without an appropriate licence,
    17. other activities that violate these Terms and Conditions, decency, generally accepted principles of Internet usage, generally applicable law, the rights of Fintecom or third parties.
  11. Permanent cessation of the Service provision means irreversible termination of the agreement with immediate effect. Permanent cessation of the Service provision may also result in the deletion of all data entered by the User from the Fintecom ICT system, unless:
    1. the law provides otherwise,
    2. authorized government authorities have requested Fintecom to secure the data,
    3. it may be impossible to remove all data entered by the User from the Fintecom ICT system due to the nature of the Service or the Functionalities (e.g. in connection with the obligations arising from the Act of 1 March 2018 on Counteracting Money Laundering and Terrorism Financing).
  12. Temporary cessation of the Service provision limits the User’s use of:
    1. the Service, or
    2. its Functionalities.

    Temporary cessation of the Service provision may be revoked after the User has provided appropriate explanation regarding the violations that have occurred.

  13. Fintecom may process data of Users who have been permanently terminated for the purpose and to the extent necessary to clarify the circumstances of the unauthorized use of the Service.
  14. Pursuant to Article 14 par. 2 and 3 of the Act, Fintecom is entitled to prevent (block) access to data entered by the User into Fintecom’s ICT system in the case of:
    1. receiving an official notification of the unlawful nature of the stored data or related activities,
    2. obtaining reliable information or becoming aware in any way of the unlawful nature of the stored data or related activities.
  15. In the case referred to in par. 16, Fintecom shall immediately notify the User of its intention to prevent access to data (blocking). The notice will be sent to the User’s GG Number.
  16. Fintecom reserves the right to block the registration of a GG Account if it detects attempts to register GG Accounts for purposes that violate the Terms and Conditions or are incompatible with the purpose of the GG Platform, in particular:
    1. mass registration of GG accounts,
    2. registration with spam bots,
    3. use of a VPN, Proxy or TOR at the time of registration,
    4. accounts opened using SMS codes sent to temporary phone numbers,
    5. use of temporary email addresses with domains with a bad reputation,
    6. registrations from IP addresses used for fraud.

Section IV. LIMITS USED IN THE GG STANDARD VERSION

  1. In the free version, GG Standard, the User receives access to all functionalities of the GG Instant Messenger, including the following in limited form:
    1. limited space in the Gallery for photos,
    2. limit of messages and invitations sent monthly to strangers,
    3. access time for transmitted files.

Section V TERMS OF THE PAID SERVICE

  1. The Basic Service is free – GG Standard.
  2. Fintecom provides the Users with access to some of the functionalities of the Service for a fee.
  3. The use of the paid GG functionalities by the User is possible only with the User’s consent and after acceptance of the Terms and Conditions of a specific service and, in some cases, after verification of their GG account referred to in Section II par. 4.

V.1. GG PREMIUM

  1. Purchase of the “GG Premium” service additionally offers the User:
    1. disabling advertisements on every device on which the User logs in,
    2. more space in the Gallery for photos (up to 100 photos/up to 25 MB total),
    3. no limit on messages and invitations sent to strangers,
    4. extended access to uploaded files from 90 to 365 days,
    5. User’s profile will be at the top of the search results in the public directory.
  2. The duration of the GG Premium service depends on the package purchased by the User. The package may be:
    1. monthly,
    2. semi-annual,
    3. annual
  3. Before purchasing the GG Premium package, the User shall be obliged to read the Terms and Conditions of GG Premium available at the following address: GG Premium Terms of Service
  4. By purchasing the GG Premium package, the Users confirm that they have read the Terms and Conditions of GG Premium and accept its provisions.

V.2. GG MONEYBOX

  1. Fintecom allows the Users to set up a virtual GG Moneybox in their GG account.
  2. GG Moneybox is a payment service provided within GG, consisting of a Payment Instrument under the name “GG Moneybox”.
  3. GG Moneybox is a Service available as a mobile application, a part of the GG Instant Messenger, enabling making and receiving voluntary payments to verified GG Users. Money collected by the User in GG Moneybox may be used for any purpose in accordance with the GG Moneybox Terms and Conditions.
  4. GG Moneybox may be set up only by the Users who have been verified by Fintecom, in accordance with the Terms of Service for GG Moneybox Owners, available at https://www.gg.pl/info/regulamin for gg moneybox owners.
  5. One GG User can create only one GG Moneybox.
  6. Detailed rules for the provision of the GG Moneybox payment services by Fintecom, including the rights and obligations of the Users, rules for the issue and use of the Moneybox by the Users, as well as the manner of use and rules regarding the termination of use of the Moneybox Service are set out in the Terms of Service for GG Moneybox Owners.
  7. By setting up GG Moneybox, the User confirms to have read the Terms of Service for GG Moneybox Owners, which is a necessary condition for using the payment services provided by Fintecom.
  8. Payments to the GG Moneybox may be transferred by any person, also a person that is not logged into the GG Instant Messenger, who has accepted the GG Moneybox Terms of Service for Payers, available at: https://www.gg.pl/info/regulamin dla wplacajacych do skarbonki gg/.

Section VI TERMS FOR ENTERING INTO THE AGREEMENT AND COMMENCEMENT OF SERVICE AND TERMINATION OF THE AGREEMENT

  1. Provision of the Service requires registration of a GG Account.
  2. During registration, it is required to provide certain data, including, with the consent of the User, personal data.
  3. During registration, the User confirms that they are over 16 years of age and accept responsibility for the correctness of the data provided. In the event of providing false personal data, some functionalities of the Service may remain unavailable to the User until the data is corrected.
  4. After registration, in order to use the Service, the User is assigned an individual account designation (GG Number).
  5. The User shall not have the right to dispose of the GG Number in any other way than specified in the Terms and Conditions.
  6. If the User terminates the agreement for the provision of the Service (deletion of the account), or if the agreement for the provision of the Service is terminated by Fintecom due to a use of the Service by the User in a manner that violates the Terms and Conditions:
    1. The User will lose the right to use their GG Number,
    2. Fintecom has the right to assign the GG Number to another User,
    3. in the case of GG Numbers purchased from the Official GG Store (https://shop.gg.pl/), Fintecom shall have the right to assign a GG Number to another User after a period of at least 24 months from the date of the last login to the GG Service.
  7. The Service Agreement is entered into upon acceptance of the Terms and Conditions and commencement of the Service.
  8. The User retains access to the Service with their login and password.
  9. The Service Agreement is terminated:
    1. at the User’s request, or
    2. by Fintecom, in the cases indicated in Section III par. 9 of the Terms and Conditions, subject to the provisions of par. 11-16.
  10. The Service Agreement may be terminated by Fintecom if the user does not use the Service (understood as not logging into the Service) continuously for a period of time:
    1. at least 12 months,
    2. at least 24 months for GG numbers purchased from the Official GG Store.
  11. Termination of the Service Agreement may result in the deletion of all data entered by the User from Fintecom’s ICT system, unless:
    1. the law provides otherwise, or
    2. deletion of all data entered by the User from Fintecom’s ICT system is impossible due to the nature of the Service or Functionality.
  12. In the event that the User has made more than one registration, the effect of the termination of the Service will only occur with respect to access to the Service individualized with the corresponding GG Number.
  13. The personal data controller is Fintecom.
  14. The rules for the processing of personal data as part of the Service are contained in the Privacy Policy.

Section VII LIABILITY

  1. The User is responsible for all actions taken after logging in with the login and password.
  2. The User uses:
    1. the Service, in accordance with these Terms and Conditions,
    2. services provided by third parties, at User’s own risk. The use of services provided in the GG Instant Messenger by third parties does not exclude or limit Fintecom’s liability related to the provision of the Service to the extent that it may not be excluded or limited by law.
  3. Fintecom shall be liable to Users for non-performance or improper performance of the Service within the scope of the Terms and Conditions, unless the non-performance or improper performance of the Service is a consequence of circumstances for which Fintecom is not legally responsible.
  4. In accordance with Article 14 of the Act, Fintecom is not responsible for the data entered by the Users and stored in Fintecom’s ICT system.
  5. In accordance with Article 13 of the Act, Fintecom is not responsible for the transmitted data by providing automatic and short-term intermediate storage of such data in order to expedite re-access to the data at the request of another entity (another User).
  6. Fintecom is not responsible for the consequences of non-performance or improper performance of obligations undertaken towards the User by other Users.
  7. Fintecom is not responsible for any consequences of the User’s use of applications to which the Platform provides access, but which are made available by third parties, of which the User will be informed before commencement of use of the specific application.
  8. Fintecom is not responsible for:
    1. removal of data entered by the Users into Fintecom’s ICT system from ICT systems outside Fintecom’s control,
    2. consequences of use of the Service or its Functionalities by means of software other than Fintecom’s software or third party software provided with the consent of and by Fintecom, specified at: List of Authorised Software
    3. consequences of providing third parties with login and password by the Users.
  9. The Users may not create GG accounts using a phone number and/or email address that does not belong to the person creating the account. Fintecom is not responsible for such actions.
  10. Fintecom may temporarily or permanently block a GG account if it becomes aware that such account has been created using a phone number and/or email address of someone other than the person creating the account.
  11. The Terms and Conditions shall be applied taking into account the Users’ rights under consumer laws.

Section VIII INTELLECTUAL PROPERTY

  1. Fintecom shall be entitled to the rights to works, within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, designations and trademarks made available within the Platform, to the extent necessary to provide the Service.
  2. Works, signs and trademarks made available as part of and for the purpose of providing the Service shall be protected by law.
  3. The User is entitled to use the works within the framework of permitted private use, as provided by law.
  4. Any use beyond the permitted private use requires the prior consent of the authorized entity.
  5. The terms of use of software provided by Fintecom are set out in the respective licence agreements.
  6. The licence agreement for the use of software provided by Fintecom for the Service constitutes an appendix to the Terms and Conditions.

CHAPTER IX COMPLAINT PROCEDURE

  1. Complaints regarding the provision of the Service may be submitted due to:
    1. failure to perform the Service, or
    2. improper performance of the Service.
  2. Complaint may be submitted in the following forms:
    1. in writing, by mail to the following address: ul. Marszalka Pilsudskiego 45, 75-502 Koszalin,
    2. in electronic form, via email address: reklamacje@gg.pl.
  3. The complaint should include:
    1. name of the claimant,
    2. e-mail address provided during registration
    3. the ID under which the User appears on the Platform (GG number)
    4. the subject matter and circumstances justifying the complaint.
  4. Complaints are processed in the order of receipt, but no later than within 14 (fourteen) days. In justified cases, if the complaint requires a longer period of time to process, Fintecom may extend the deadline for processing the complaint by additional 14 (fourteen) days, of which the claimant will be informed.
  5. If the complaint contains deficiencies that prevent its consideration, Fintecom will immediately call the claimant to complete the application with the instruction that failure to complete the complaint will leave it without consideration.
  6. The claimant is informed about the manner of complaint processing in the form in which the complaint was originally submitted.

Section X FINAL PROVISIONS

  1. The current version of the Terms and Conditions shall be made available in a manner allowing for storage and reproduction in the ordinary course of activities.
  2. Any amendment to the Terms and Conditions will become effective:
    1. in 15 (fifteen) days from the date of notification of the change or at any other time indicated by Fintecom, but not less than 15 (fifteen) days; in the event that the User does not consent to the change, the User shall provide Fintecom with an appropriate statement, including through Fintecom’s ICT system, before the change takes effect and shall cease using the Service from that date.
    2. immediately upon notice of the change, or within such other time as Fintecom may indicate, if the changes concern the provisions of the Terms and Conditions that do not affect the Users.
  3. Polish law shall be applicable to the assessment of the rights and obligations arising from the Terms and Conditions, in particular the provisions of the Civil Code and the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014 item 827).
  4. Amicable dispute resolution: The European Commission operates an online dispute resolution platform. This platform is available at: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=PL.
  5. Fintecom stipulates that the use of other alternative dispute resolution mechanisms requires the consent of Fintecom.

Appendix – Licence Agreement for the use of software provided by Fintecom for the Service

  1. The software made available by Fintecom to provide the Service is a computer program (hereinafter: “Program”) within the meaning of the Act of 4 February 1994 on Copyright and Related Rights (hereinafter: “Copyright”).
  2. All property rights and intellectual property rights, including copyrights to the Program as a whole, as well as to its individual parts, excluding third-party software implemented in the Program, are held by Fintecom.
  3. Fintecom authorizes the User to use the Program (hereinafter the “Licence”) in the manner outlined by the copyright law for computer programs to the extent necessary for the use of the computer program in accordance with its intended use, by a person who legally came into possession of it, excluding the right to correct errors in the Program.
  4. In connection with the intended use of the Program, the scope of the granted Licence (the authorization defined in paragraph 3 above) is limited to the User’s use of the Service under the Terms and Conditions.
  5. Fintecom does not grant the User the right to use Fintecom’s trademarks.
  6. All rights to works that are not computer programs externalized in the structure of the Program (photographs, animations, images, video and sound recordings, music, texts and others), excluding works originating from third parties, belong to Fintecom and, in accordance with the provisions of the Licence, it is allowed to use them only within the scope of the Service by the User under the Terms and Conditions.
  7. All rights to the content to which the Program provides access belong to the owners of such content (“Third Party Content”). Fintecom does not grant the Users the right to use Third Party Content. Third Party Content may be protected by copyright or other laws or international agreements, and use of such content in a manner contrary to the will of the right holder may constitute an infringement of third party rights.
  8. The Licence becomes effective upon the commencement of the Service.

All of the deliverable code in SQLite has been dedicated to the public domain by the authors. All code authors, and representatives of the companies they work for, have signed affidavits dedicating their contributions to the public domain and originals of those signed affidavits are stored in a firesafe at the main offices of Hwaci. Anyone is free to copy, modify, publish, use, compile, sell, or distribute the original SQLite code, either in source code form or as a compiled binary, for any purpose, commercial or non-commercial, and by any means.

The previous paragraph applies to the deliverable code in SQLite – those parts of the SQLite library that you actually bundle and ship with a larger application. Portions of the documentation and some code used as part of the build process might fall under other licenses. The details here are unclear. We do not worry about the licensing of the documentation and build code so much because none of these things are part of the core deliverable SQLite library.

All of the deliverable code in SQLite has been written from scratch. No code has been taken from other projects or from the open internet. Every line of code can be traced back to its original author, and all of those authors have public domain dedications on file. So the SQLite code base is clean and is uncontaminated with licensed code from other projects.

Obtaining An Explicit License To Use SQLite

Even though SQLite is in the public domain and does not require a license, some users want to obtain a license anyway. Some reasons for obtaining a license include:

You are using SQLite in a jurisdiction that does not recognize the public domain.

You are using SQLite in a jurisdiction that does not recognize the right of an author to dedicate their work to the public domain.

You want to hold a tangible legal document as evidence that you have the legal right to use and distribute SQLite.

Your legal department tells you that you have to purchase a license.

If you feel like you really have to purchase a license for SQLite, Hwaci, the company that employs the architect and principal developers of SQLite, will sell you one.

In order to keep SQLite completely free and unencumbered by copyright, all new contributors to the SQLite code base are asked to dedicate their contributions to the public domain. If you want to send a patch or enhancement for possible inclusion in the SQLite source tree, please accompany the patch with the following statement:
